O objetivo deste artigo é investigar quais são as bases ontológicas da ética do futuro, tendo como leitmotiv o conceito de reciprocidade ou, sendo mais preciso, justamente a sua prescindibilidade no âmbito ético, a qual repercute como necessidade ontológica de fundamentação. Partiremos de uma análise do próprio conceito de “ética do futuro” para, explicitar, na sequência, por que, com Jonas, o futuro se torna objeto ético e como ele exige a prescindibilidade da reciprocidade. A partir daí, pretendemos mostrar que a (...) fundamentação ontológica da ética é o caminho de solução para o problema da ausência de reciprocidade e de que modo ela se constitui como crítica àquilo que Jonas chama de dois dogmas da filosofia: “nenhuma verdade metafísica” e “nenhum caminho do é para o deve” (PR, p. 95). Por isso, finalmente, tentaremos mostrar que é contra esses dogmas que se ergue a proposta jonasiana, fundamentada numa metafísica racional que nada mais é do que uma ontologia biológica. (shrink)

Forest tenure reforms are occurring in many developing countries around the world. These reforms typically include devolution of forest lands to local people and communities, which has attracted a great deal of attention and interest. While the nature and level of devolution vary by country, all have potentially important implications for resource allocation, local ecosystem services, livelihoods and climate change. This book helps students, researchers and professionals to understand the importance and implications of these reforms for local environmental quality, climate (...) change, and the livelihoods of villagers, who are often poor. It is shown that local forest management can often be more successful than top-down management of common pool forest resources. The relationship of local forest tenure reform to the important climate change initiative REDD+ is also considered. Kant holds that the a human subject's free causation, as well as the deliberations and decision preceeding it, are literally timeless. This paper tries to defend this doctrine of timeless agency by first distinguishing three senses of "cause", then showing the relationship between cause and time-determination in the theoretical philosophy, and finally relating the timelessness of free agency to the status of the representations of perception. The result is that whereas agency has no time in isolation, it may borrow enough (...) time for its purposes from the theoretical realm. Kant meint, daß die freie Verursachung durch ein menschliches Subjekt, genauso wie die Überlegungen und die Entscheidung, die ihr vorausgehen, buchstäblich zeitlos sind. Der Beitrag versucht, diese Lehre von einem zeitlosen Handeln zu verteidigen. Zunächst wird zwischen drei verschiedenen Bedeutungen von "Ursache" unterschieden. Dann wird die Beziehung zwischen Ursache und Zeitbestimmung in der theoretischen Philosophie dargestellt. Schließlich wird die Zeitlosigkeit freien Handelns mit dem Status der Gegenstände der Wahrnehmung in eine Beziehung gesetzt. Das Ergebnis ist, daß das Handeln, während es für sich selbst betrachtet keine Zeit hat, für seine Zwecke doch genügend Zeit aus der theoretischen Sphäre entlehnen kann. (shrink)

In this article, we explore the possibility of adding a new role to the clinical encounter: an illness doula. Even though research and education in medical humanities and narrative medicine have made improvements in humanizing healthcare, progress is slow and ongoing. There needs to be an intervention in the practice of healthcare now for people currently going through the system. An illness doula, like a birth doula, would facilitate and insure that attention is paid to the personal needs and desires (...) of the patient in the present system. We envision illness doulas having the ability and availability to accompany the patient throughout the healthcare process, to help communicate with clinicians, and to ensure that patient preferences are understood and respected along the way. We discuss how this idea emerged through the clinical encounters of two of our authors, the possibilities and limitations of creating a new role for illness doulas, and the logistics of how to put this new role into play. The authors use social science methodology to determine whether a doctrinal shift—from an objectivist view of criminality in the common law to a subjectivist view in modem criminal codes—is consistent with lay intuitions of the principles of justice. Commentators have suggested that lay perceptions of criminality have shifted in a way reflected in the doctrinal change, but the study results suggest a more nuanced conclusion: that the modern lay view agrees with the subjectivist view of modern codes in defining the (...) minimum requirements of criminality, but prefers the common law's objectivist view of grading the punishment deserved. The authors argue that there is practical value in having criminal law track shared community intuitions of the proper rules for assigning liability and punishment. For that reason, the study results support the often criticized subjectivist view of modern codes in setting the minimum requirements of liability, but disapprove of the modern codes' shift away from the common law's objectivist view of grading.
